These Terms of Service (“Terms”) govern your access to and use of Zodi Bingo (the “App” and the “Service”). By downloading, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Who We Are
The Service is operated by Alexandre Chimeno Bort, doing business as Xalera.cat (“Zodi Bingo,” “we,” “us,” “our”).

2. Eligibility
You must be at least 13 years old to use the Service (or the minimum age required in your country). If you are under the age of majority, you represent that you have permission from a parent or legal guardian where required by law.
3. Accounts and Security
- You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
- You agree to provide accurate information when required and to keep it updated.
- We may request reasonable verification to prevent fraud, abuse, or security risks.
4. License to Use the Service
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to install and use the App for your personal, non-commercial use (unless we explicitly allow otherwise).
All rights not expressly granted are reserved by Zodi Bingo.
5. User-Generated Content (UGC)
The Service may allow you to create, upload, post, send, or otherwise make available content such as messages, images, avatars, and other materials (“Content”).
5.1 Your responsibility
You are solely responsible for your Content and the consequences of making it available. You must comply with our UGC Policy.
5.2 License you grant us
By submitting Content through the Service, you grant Zodi Bingo a worldwide, non-exclusive, royalty-free, sublicensable and transferable license to host, store, reproduce, modify (for technical purposes such as formatting/resizing/compression), distribute, display, and perform your Content only as necessary to:
- operate and provide the Service,
- display your Content to the recipients/audience you choose within the Service,
- maintain safety, prevent abuse, and enforce these Terms,
- comply with legal obligations.
This license ends when you delete your Content, except that: (a) residual copies may remain in backups for a limited period, and (b) Content shared with others may remain visible if they have not deleted it, and (c) we may retain Content where required by law or for legitimate safety/security purposes.
5.3 Moderation
We may (but are not obligated to) review, remove, restrict, or disable access to Content or accounts that violate these Terms or the UGC Policy, or that create risk for users or the Service.
6. Prohibited Conduct
You agree not to:
- violate any applicable law or regulation;
- infringe others’ rights (including intellectual property, privacy, or publicity rights);
- harass, threaten, defame, or promote hate or violence;
- exploit or endanger minors (zero tolerance for child sexual abuse material);
- upload or distribute malware, phishing, spam, or other harmful code/content;
- attempt to gain unauthorized access to accounts, systems, or data;
- interfere with or disrupt the Service (including scraping or automated abuse);
- circumvent suspensions, bans, or security measures.
7. Intellectual Property
The Service, including its software, design, user interface, trademarks, logos, and our proprietary content, is owned by or licensed to Zodi Bingo and is protected by intellectual property laws.
You may not copy, modify, distribute, sell, lease, reverse engineer, or create derivative works from the Service except to the extent permitted by law.
If you believe Content on the Service infringes your rights, contact contact@zodibingo.com with sufficient information to locate and evaluate the claim.
8. Third-Party Services (including Google Play)
The Service may rely on third-party providers (e.g., hosting, CDNs, analytics) and may contain links or integrations. We do not control third-party services and are not responsible for their availability or terms.
Your download and use of the App via Google Play may also be subject to Google’s terms and policies. In case of conflict between Google’s terms and these Terms regarding Google’s responsibilities, Google’s terms govern those responsibilities.
9. Changes, Availability, and Updates
We may modify, suspend, or discontinue the Service (in whole or in part), including features and functionality, at any time for maintenance, safety, legal, or business reasons. We may also release updates to the App; you may need to install updates to continue using the Service.
10. Suspension and Termination
We may suspend or terminate your access to the Service at any time if we reasonably believe:
- you violated these Terms or the UGC Policy,
- your behavior creates risk or harm to users, the public, or the Service,
- we must do so to comply with law or enforce legal obligations,
- your account is associated with fraud, abuse, or security threats.
You may stop using the Service at any time. Sections that by their nature should survive termination will survive (including IP, disclaimers, limitation of liability, and indemnity).
11. Disclaimer of Warranties
To the fullest extent permitted by law, the Service is provided “AS IS” and “AS AVAILABLE.” We do not warrant that the Service will be uninterrupted, error-free, secure, or free from harmful components, or that any Content will be accurate, complete, or appropriate.
12. Limitation of Liability
To the fullest extent permitted by law, Zodi Bingo will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, revenue, goodwill, or business interruption arising out of or related to your use of (or inability to use) the Service.
Where liability cannot be excluded, it will be limited to the maximum extent permitted by applicable law.
13. Indemnification
You agree to defend, indemnify, and hold harmless Zodi Bingo and its operator from and against claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to:
- your use of the Service,
- your Content,
- your violation of these Terms, the UGC Policy, or applicable law,
- your infringement of any third-party rights.
14. Privacy
Our collection and use of personal data is described in our Privacy Policy.
15. Changes to These Terms
We may update these Terms from time to time. We will post the current version on this page and update the “Last updated” date. By continuing to use the Service after changes become effective, you agree to the updated Terms.
16. Governing Law and Venue
These Terms are governed by the laws of Spain, excluding conflict-of-law rules, except where consumer protection laws require otherwise.
Any disputes will be resolved exclusively in the courts located in Amposta (Tarragona), Spain, unless applicable law requires a different venue.
17. Miscellaneous
- Severability: If any provision is found unenforceable, the remaining provisions remain in effect.
- No waiver: Our failure to enforce a provision is not a waiver.
- Assignment: We may assign these Terms as part of a merger, acquisition, or sale; you may not assign without our consent.
- Entire agreement: These Terms, the Privacy Policy, and the UGC Policy form the entire agreement regarding the Service.
